UK HealthCare MyChart Terms & Conditions 


1. Introduction. The UK HealthCare MyChart service (“MyChart”) is an electronic health record portal developed for patients of UK HealthCare. It is provided solely for the convenience of patients of UK HealthCare and its affiliates, as identified in its Notice of Privacy Practices. Your access to and use of MyChart is subject to and governed by these MyChart Terms and Conditions (“Terms and Conditions” or “Agreement”) and applicable law, rules, and regulations. Throughout this Agreement, UK HealthCare and its affiliates are collectively referred to as “UK HealthCare,” “we,” or “us.” Throughout this Agreement, users of MyChart, which includes patients and/or proxies, will be referred to as “you” or “Users.” 

MyChart is intended to help you better communicate with your provider’s office and staff, to access portions of your medical record, and to provide general educational information. You should never use MyChart for urgent matters. For all urgent matters, please contact your provider by telephone, go to an emergency room, or dial 911.

To proceed, you must agree to the following conditions governing access to MyChart. To obtain access to MyChart on behalf of yourself or as a proxy, you must agree to be bound by these Terms and Conditions, and your use of MyChart constitutes agreement to the Terms and Conditions. The most current version of these Terms and Conditions can be accessed at any time by selecting the “MyChart Terms of Use” link on the MyChart website. UK HealthCare may change these Terms and Conditions from time to time and may notify you of these changes upon login, requiring you to review and accept them before you continue to use MyChart. Your continued use of MyChart after such changes become effective constitutes acceptance of the new terms. If you do not agree to such changed terms, or if at any time you no longer wish to otherwise abide by these Terms and Conditions, you should not access or use MyChart. You should notify UK HealthCare immediately by calling 859-323-5117. UK HealthCare reserves the right to revoke or deactivate your account at any time for any reason without notice or cause. 

2. Email and Text Privacy, Disclaimer, and Consent. Certain portions of MyChart permit you to securely exchange electronic messages and other information with UK HealthCare providers. You will, however, receive internet email messages notifying you that new information is available in your MyChart account. These email messages will not contain any confidential medical information, but the email is not sent secured or encrypted.  Additionally, any person with access to your email account will be able to see this notification. This can include you, your spouse, employer, or anyone else that can access your email account. You should take this into account when providing an email address. UK HealthCare is not responsible if someone accesses your email and sees the message that you have an update to your MyChart account.

UK HEALTHCARE AND ITS EMPLOYEES, TRUSTEES, OFFICERS AND AGENTS DISCLAIM ANY AND ALL LIABILITY FOR DAMAGES ARISING IN CONTRACT, TORT, OR OTHERWISE FROM USER’S FAILURE TO PROVIDE A SECURE EMAIL ADDRESS. 

You expressly authorize UK HealthCare to text you at any wireless phone number associated with your account(s) for those communications you have elected to receive via text message.  You may update your communications preferences (including opting-out) at any time on the “Communication Preferences” page under “Account Settings.” You understand that such texts may result in charges to you from your cell phone provider. You agree that methods of contact may include use of auto-generated messages or an automatic dialing system. You understand that the text contents may include your protected health information concerning your treatment or payment for your health care or any of the other categories listed on the “Communications Preferences” page, including appointment reminders, availability or medication reminders, questionnaires and/or billing information depending on your communication preferences elections. You understand that a text message is unencrypted and may be intercepted or visible to be read by third parties. You understand that this request to receive text messages will apply to all future text messages unless you request a change in writing. You understand that there is no assurance of confidentiality of information when communicated via texts. You understand that you are not required to agree to receive text messages to set up or access your MyChart account.  

3.  Your Responsibilities as a MyChart User. You agree that MyChart is a communication service offered as a convenience to you and that UK HealthCare has the right to end access to MyChart at any time, for any reason, including your misuse of MyChart. Examples of misuse may include, but are not limited to, using inappropriate or derogatory language or tone directed at members of the care team or making threats towards members of the care team.

You understand that MyChart provides you with online access to portions of your UK HealthCare electronic medical record and that you are solely responsible for any sharing of such content that you intentionally or unintentionally communicate to others. You understand that messages will be routed to the appropriate UK HealthCare department as necessary for handling, and therefore UK HealthCare employees other than your healthcare provider may be involved in addressing your request. Therefore, use of the MyChart account may not be appropriate if there is sensitive information that you would only wish to discuss directly with a particular medical provider. You understand that entries you make using MyChart may become part of your medical record.

MyChart may not be used for any illegal or unethical activities. Hacking, attempted access, or other forms of inappropriate access or attempted access to unauthorized areas or information on this site will lead to termination of use and potential legal prosecution.

Please note: MyChart is not your complete medical record, nor is it your official UK HealthCare medical record. You may request a copy of or an amendment to your official, complete UK HealthCare medical records by calling UK HealthCare at 859-323-5117. 

NOT FOR EMERGENCIES. You agree that you understand that MyChart is not for medical emergencies or urgent situations. IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY OR URGENT SITUATION, CALL YOUR PROVIDER OR 911 IMMEDIATELY.

4. Access to a Minor Patient’s MyChart Account. For patients age 11 and under, Parent(s)/Legal Guardian(s) may request access to the minor’s MyChart account. UK HealthCare will grant access to individuals with parental rights or legal guardianship with respect to the patient once the Parent(s)/Legal Guardian(s) agrees to the Proxy MyChart Agreement. The Parent(s)/Legal Guardian(s) is considered a “proxy” and will have proxy access to the minor’s MyChart account. If the proxy’s legal relationship with the patient changes, the proxy must inform UK HealthCare immediately by calling UK HealthCare at 859-323-5117. 

For patients age 12 to 17, UK HealthCare requires that the minor patient grant the proxy access to Parent(s)/Legal Guardians(s). Except under special circumstances, e.g., a minor patient who lacks decisional capacity, UK HealthCare will automatically terminate proxy access to a minor’s MyChart when the patient turns 12 years old. The minor patient has the opportunity to grant proxy access to the Parent(s)/Legal Guardian(s). In addition to Parent(s)/Legal Guardian(s) access to a patient’s MyChart account, UK HealthCare allows patients age 12 and older to access his/her own medical information through his/her MyChart account by agreeing to the MyChart Agreement. 

When the patient turns 18, UK HealthCare will automatically terminate proxy rights, except under special circumstances.

5. Security and Confidentiality. UK HealthCare is committed to protecting the confidentiality of medical information. We afford the same degree of confidentiality to medical information stored on MyChart as is given to medical information stored in medical charts at UK HealthCare and other medium. We limit UK HealthCare employees’ access and ability to enter or view information based on their role in a patient’s care. Firewalls, passwords, encryption and audit trails are further used to safeguard medical information. We identify the records released to note the time and date of access each time the MyChart account is accessed. We have taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use. You agree that if you accidentally gain access to another patient’s information, you will stop viewing it and will notify UK HealthCare immediately by calling 859-323-5117. 

Your role in maintaining the security of the MyChart account to which you have access is: (1) Changing your password on a regular basis, and (2) Keeping your login ID and password confidential.

You understand that no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information. When you access a MyChart account, information will be transmitted over a medium that is beyond UK HealthCare’s control. YOU HEREBY EXPRESSLY ASSUME THE SOLE RISK OF ANY UNAUTHORIZED DISCLOSURE OR INTENTIONAL INTRUSION, OR OF ANY DELAY, FAILURE, INTERRUPTION, OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THIS SERVICE. Once the information is received by us, medical information will be treated as confidential and given the same protection that all other UK HealthCare medical records are given.

User names and passwords provide two layers of authentication and are stored in an encrypted database that is isolated from the Internet.

6. MyChart ID and Password. When you initially enroll in MyChart, UK HealthCare provides you with an access code which you use to create a personal login name (“MyChart ID”) and a password. Once this access code has been used, it is no longer valid. It is extremely important that you keep your login name and password completely confidential. Anyone with access to your login name and password will be able to access the same confidential medical information you can. That person will also be able to read your messages and send new messages as if they were you. It is your responsibility to prevent disclosure of your login and password and to change your password if you feel that your security has been compromised. You may change your password at any time.

You understand and agree that UK HealthCare takes no responsibility for and disclaims any and all liability for damages arising from a breach of medical record confidentiality resulting from your sharing or losing your password. If UK HealthCare discovers that you have inappropriately shared your password or that you may have misused or abused your access privileges in any way, access to MyChart may be terminated immediately.

7. Response to Electronic Communication. UK HealthCare will use reasonable effort to provide a timely response to electronic inquiries which are not of an urgent nature. For all urgent matters, please contact a provider’s office by telephone, go to an emergency room or dial 911. You should allow at least at least two (2) business days for a response. If the UK HealthCare provider is out of the office or unavailable, messages sent via MyChart may be routed to other authorized caregivers within UK HealthCare for a timely response to your request. Delays can occur based upon, but not limited to, volume and availability of staff, the complexity of a situation, or technology occurrences outside of UK HealthCare’s control. With respect to any electronic communication, UK HealthCare is only able to respond to such communications based on the information you provide. If the information is insufficient, UK HealthCare will be unable to provide accurate and reliable services. Electronic communication with other external organizations is outside of UK HealthCare’s control. It may take longer to receive a response, based on the provider or organization with whom you are communicating. Any electronic inquiries sent to a non-UK HealthCare provider or non-UK HealthCare organization are not routed or monitored by UK HealthCare. Please contact that provider or organization directly if you have any questions or concerns. It is your sole responsibility to monitor your account for messages and other information and to respond and/or to act (or not) upon them in a timely and appropriate manner.

8. Online Payments. You may use MyChart to view your UK HealthCare billing statements online and make online payments online for healthcare services you receive from us. Please note that we use a third party to process the payments you make using the MyChart service. You agree to comply with any terms and conditions of the third-party processor in connection with your use of such third-party processor services.

9. Scope of Access. The MyChart account to which you have access may not contain all of a patient’s medical information and you agree to access such account knowing that it may be incomplete.

10. Web site Links. UK HealthCare may offer links to related medical websites not managed by UK HealthCare. These website links are for informational purposes only. The website content is not intended to be professional medical advice, diagnosis, or treatment or a substitute for professional medical advice, diagnosis, or treatment.  UK HealthCare does not endorse and has not verified the accuracy of the information in/on these websites and the website information does not reflect the opinions of UK HealthCare or our providers. You should not rely on any of the information found on the websites for purposes of treatment or diagnosis and any reliance is solely at your own risk. Always seek the advice of your physician or other qualified health professional with any questions you may have regarding your health.  

11. Discontinuing Use of MyChart. You may un-enroll from your use of MyChart at any time by calling 859-323-5117.

If, for any reason, it is determined at our sole discretion that you have violated the MyChart Terms and Conditions and/or abused the use of this service, UK HealthCare has the right to restrict and/or terminate your access to MyChart. Such conduct may include, but is not limited to, the use of unlawful, threatening, fraudulent, libelous, defamatory, obscene, or abusive information or language. 

12. No Warranties. THIS SITE AND THE CONTENT CONTAINED HEREIN ARE PROVIDED BY UK HEALTHCARE ON AN “AS IS” BASIS. UK HEALTHCARE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND EXPRESS OR IMPLIED AS TO THE OPERATION OF ITS SITES, OR THE CONTENT, PRODUCTS AND/OR SERVICES INCLUDED THEREIN. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, UK HEALTHCARE DISCLAIMS ALL WARRANTIES, EXPRESS, OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND/OR INFRINGEMENT.

IN ADDITION, UK HEALTHCARE DOES NOT GUARANTEE THAT USE OF MYCHART WILL BE FREE FROM UNAVAILABILITY OF INFORMATION, DOWNTIME, SERVICE DISRUPTIONS, INTENTIONAL OR INADVERTENT INTRUSIONS, VIRUSES OR WORMS OR OTHER MECHANISMS THAT MAY ATTACK YOUR COMPUTER. YOU ACKNOWLEDGE THAT YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOUR COMPUTER HAS ADEQUATE PROTECTIONS AGAINST ANY OF THE FOREGOING. IN ADDITION, YOU ACKNOWLEDGE THAT YOUR INFORMATION WILL BE TRANSMITTED OVER THE INTERNET AND THAT THERE IS NO GUARANTEE OF ACCURACY OR SECURITY.

13. Limitation of Liability. UK HealthCare takes reasonable and appropriate steps to secure your medical information in MyChart. We take no responsibility for, and disclaim any and all liability to you or anyone else resulting from, arising out of, or in any way relating to or connected with, directly or indirectly, MyChart confidentiality, privacy, or security failures due in whole or in part to any act or omission by you or any third party, including without limitation not logging out of an active session; lost or stolen User Information; use of your MyChart account from a publicly available computer or Internet kiosk (e.g., a computer in a public library or hotel business center); downloading, printing, publishing, reproducing, transcribing, storing, transmitting in any form or by any means (electronic, mechanical, photo reproduction, recordation or otherwise), redistributing or selling information from MyChart; user computer settings or installed software products that may compromise information security; failure to maintain anti-virus software or regularly apply software updates on the user's computer; or any other acts, omission, events or circumstances outside UK HealthCare’s direct control.

14. Use of Third-Party Services. You may choose to use other services provided by third parties in conjunction with your use of MyChart. Such services may include, but are not limited to, translation services, location services, and other third-party offerings. Any links to such services are provided for your convenience only. Neither Epic nor UK HealthCare have control over the contents of these services, and neither Epic nor UK HealthCare accept any responsibility for them or for any loss or damage that may arise from your use of them. Such services may require you to submit your information to a third party, which may result in a copy of your information being used and/or stored by a third party. If you decide to access any such services in conjunction with your use of MyChart, you do so entirely at your own risk and subject to the terms and conditions of use for such services.

Some of the material on the UK HealthCare site is provided by third parties and UK HealthCare shall not be held responsible for any such third-party material. UK HealthCare disclaims any responsibility for, or liability related to, such third-party material. Any questions complaints or claims related to any product should be directed to the appropriate third party.

15. Governing Law. This Agreement shall be governed by the laws of the Commonwealth of Kentucky notwithstanding any conflicts of law provisions to the contrary.  You further agree that any legal action which is brought on the basis of this Agreement shall be filed in Franklin Circuit Court of the Commonwealth of Kentucky.

16. Modification of Terms and Conditions. You understand and agree that UK HealthCare may modify these Terms and Conditions at any time. Your continued use of MyChart will signify your continued agreement to these Terms of Conditions as they may be revised.
